These Terms and Conditions set out the basis on which Waste Clearance Surrey provides waste removal, rubbish clearance, and related collection services. By making a booking, accepting a quotation, or allowing our team to commence work, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services.
These terms apply to all domestic, commercial and trade customers using our waste clearance and collection services. Any variations must be agreed in writing by an authorised representative of Waste Clearance Surrey.
In these Terms and Conditions, the following expressions have the meanings set out below:
"Company", "we", "us" and "our" mean Waste Clearance Surrey.
"Customer", "you" and "your" mean the person, business or organisation requesting our services.
"Services" mean any waste clearance, rubbish removal, bulky waste collection, loading, transport, recycling or disposal services provided by us.
"Waste" means any items, goods, materials or refuse that you ask us to remove as part of the Services.
"Contract" means the agreement formed between you and us when you confirm a booking or accept a quotation subject to these Terms and Conditions.
We provide waste clearance and collection services primarily within Surrey and nearby areas. Acceptance of any booking is subject to our confirmation that the service location is within our operating area and that our vehicles can access the site safely. We may decline bookings that fall outside our usual service area or where access or parking is not reasonably available.
You may request a booking for our waste clearance services by telephone, email or online enquiry. When making a booking, you must provide accurate information about the type and quantity of waste, the service address, access details, parking arrangements, and any relevant restrictions such as time limits or building regulations.
We may provide an estimated price based on the information you supply. All estimates are subject to final confirmation by our team on arrival, once we have inspected the waste and site conditions. The Contract is formed when you confirm that you wish to proceed with the Services and we accept your booking.
We reserve the right to refuse or cancel a booking at our discretion, for example where the waste is not suitable for collection, access is unsafe, or the information supplied is materially inaccurate.
Any quotation or price guide we provide is based on the volume, weight, type of waste and the labour required. Prices may vary if, on arrival, we find that the waste differs from your description, access is more difficult than described, or additional work is required. In such cases, we will explain the revised price before commencing or continuing the work.
All prices are quoted in pounds sterling and may be subject to applicable taxes. Unless explicitly stated, quoted prices include collection, transport, responsible disposal or recycling, and reasonable labour for loading.
We may charge for additional services such as waiting time, extra labour, dismantling, or special handling where necessary. These charges will be explained to you as early as reasonably possible.
Payment is due on completion of the Services, unless otherwise agreed in writing in advance. We may accept payment by cash, debit or credit card, or bank transfer, subject to our current payment methods.
For commercial customers or larger clearances, we may require a deposit, pre-payment in full, or written acceptance of an invoice payment arrangement before the Services commence. Where we agree to issue an invoice, payment terms will be stated on the invoice and must be strictly adhered to.
If payment is not received when due, we reserve the right to charge interest on overdue sums at the statutory rate and to recover any reasonable costs incurred in pursuing payment. Ownership of any items removed for reuse or recycling will pass to us only once payment has been made in full.
You may cancel or amend your booking by contacting us as soon as possible. If you cancel more than 24 hours before the agreed collection time, no cancellation fee will normally apply. If you cancel within 24 hours of the scheduled time, we may charge a cancellation fee to cover our administration and allocation costs.
Where our team attends the site at the agreed time and is unable to carry out the Services due to reasons within your control, including lack of access, parking restrictions, or your failure to be present where required, we may charge a call-out or wasted journey fee.
We reserve the right to reschedule or cancel a booking in the event of vehicle breakdown, staff shortages, severe weather, or circumstances beyond our reasonable control. In such cases we will try to give you as much notice as possible and will offer an alternative appointment. We will not be liable for any loss you may suffer as a result of such rescheduling or cancellation, other than any refund of pre-payments made for Services not carried out.
You are responsible for ensuring that our vehicles can access the property safely and legally, and that suitable parking is available for the duration of the clearance. Any parking charges or permits required for carrying out the Services are your responsibility and may be added to the final invoice where we pay them on your behalf.
You must ensure that the site is safe for our team to work, including clear walkways, adequate lighting and absence of dangerous conditions. If we consider that the site is unsafe or that the risk to our staff is unacceptable, we may refuse to carry out part or all of the Services. In such cases, we may still charge a reasonable fee for attendance and any partial work completed.
We collect general household and commercial waste, bulky items, furniture, appliances and garden waste, subject to legal and safety restrictions. Certain items are classified as hazardous or require specialist handling, including but not limited to asbestos, clinical waste, chemicals, solvents, gas bottles, and some electrical items.
You must clearly inform us in advance of any hazardous or unusual waste. We reserve the right to refuse collection of any waste we reasonably believe to be hazardous, illegal to carry or dispose of, or beyond the scope of our licence or insurance. If we agree to arrange specialist disposal, additional charges will apply and will be notified to you.
It is your responsibility to ensure that any items you ask us to remove are waste and that you have full authority to dispose of them. We accept no liability if you later claim that an item should not have been removed once you have directed us to take it.
Our team will arrive within the agreed time slot or as close as reasonably possible. Time slots are estimates only and not guaranteed. We will use reasonable care and skill in carrying out the Services, taking steps to minimise disturbance and to leave the area reasonably tidy once the waste has been cleared.
We are not obliged to sweep, scrub or perform detailed cleaning following removal, although we will remove loose debris directly associated with the waste collected. If you require additional cleaning or preparation works, this must be agreed as a separate service.
We will take reasonable care to avoid damage when carrying out the Services. However, minor scuffs, marks or wear may occasionally occur, particularly where items are large or access is restricted. You should take reasonable precautions to protect floors, walls and fixtures before our arrival.
Our liability for any loss or damage caused by our negligence will be limited to the reasonable cost of repair or replacement, subject to a maximum aggregate liability equal to the total price paid for the relevant Services. We will not be liable for any loss of profit, loss of business, loss of opportunity or any consequential or indirect loss.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be limited or excluded under UK law.
You agree to provide accurate information when booking, to ensure safe and reasonable access to the waste, and to comply with all relevant laws and regulations. You must not ask us to remove any waste that you know or ought reasonably to know is illegal to possess, transport or dispose of.
You must not obstruct our team while they are working and must keep pets, children and bystanders away from the work area for safety reasons. If a representative is not present during the clearance, you agree that our team may rely on your prior written or verbal instructions and that their judgement of what constitutes the agreed waste is final.
We operate in compliance with applicable UK waste legislation and regulations, including requirements relating to waste carriers, duty of care, and responsible disposal. We will take your waste only to authorised facilities for reuse, recycling or disposal and will endeavour to recycle as much material as reasonably possible.
You acknowledge your duty of care to ensure that your waste is transferred only to authorised persons. By using our services you are helping to meet that duty, but you remain responsible for providing accurate information about the origin and nature of the waste. We may issue or receive waste transfer documentation where required by law, and you agree to provide any details reasonably requested for that purpose.
If you are dissatisfied with any aspect of our Services, you should notify us as soon as possible, preferably within 48 hours of the work being completed. We will investigate your complaint and may request photographs, access to the site, or further information in order to consider an appropriate resolution.
We aim to resolve complaints promptly and fairly. Where a dispute cannot be resolved directly, both parties agree to consider reasonable methods of alternative dispute resolution before commencing formal legal proceedings, without prejudicing any legal rights you may have.
We collect and process personal information such as your name, contact details and service address for the purpose of handling enquiries, bookings, payments and service delivery. We will handle your information in accordance with applicable data protection laws and use it only for legitimate business purposes, such as providing our waste clearance services, managing accounts and meeting legal obligations.
We may retain records of your bookings, communications and payments for a reasonable period. You may contact us to request access to personal information we hold about you or to ask us to correct inaccurate details, subject to legal limitations.
We may update or amend these Terms and Conditions from time to time. The version in force at the time you make your booking will apply to that Contract. Updated terms will apply to subsequent bookings once made available. It is your responsibility to review the current terms whenever you arrange new services with us.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.
You and we both agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of our waste clearance services.
If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted and the remaining provisions shall continue in full force and effect.
These Terms and Conditions, together with any written quotation or confirmation we provide, constitute the entire agreement between you and us in relation to the Services and supersede any prior statements, representations or agreements. You acknowledge that you have not relied on any statement or representation not set out in these Terms and Conditions when entering into the Contract.
